In the session, Tucker will explain that in addition to the federal Fair Credit Reporting Act (FCRA) there are additional rules and requirements for California background checks that carry a potential $10,000 civil exposure for violating. Attendees will learn how California laws regarding due diligence and background checks are unique and different, understand key areas where businesses that hire or employ in California face significant exposure, and audit their current practices for legal compliance.

Attendees will also review critical “Only in California” requirements that include:

  • Unique language that must be in various forms and on the background report.
  • When a Spanish language form is mandated.
  • Special offshoring disclosure rules, new laws, and cases on credit reports.
  • Social media passwords use by employers.
  • Review the alphabet soup of the ICRA, FEHA, and FCRA.
  • The new EEOC rules on the use of criminal records.
  • The recent spike in class action lawsuits against employers and background firms.

Attendees will find the bottom line is that employers still need to follow all the complex requirements for California background checks as well as federal law. Speaker Bio:

Ory Tucker joined the Employment Screening Resources (ESR) team as Client Relations Manager in 2011 and was promoted to her current position of Client Experience Director in October of 2012. Ory is responsible for delivering and maintaining unequalled client experience. She has worked in the consumer reporting industry since 2005 and possesses a proven track record in client services, operations, and compliance. Along with a deep understanding of the background screening industry, her years of experience reflect the core values of ESR which include a commitment to serving the needs of clients, professional excellence, organizational integrity, consumer protection, and unequalled legal compliance.

Before joining Employment Screening Resources, Tucker worked in background and drug screening client services management, private investigation, legal, and federal government arenas. She is an active member of the National Association of Professional Background Screeners (NAPBS) where she is the sub-committee chair of the Education Committee. Tucker is also a member of the Professionals in Human Resources Association (PIHRA). Ory holds a Bachelor of Science (BS), cum laude, in criminal justice from California Lutheran University.
