Attorney Lester Rosen, Founder and CEO of Employment Screening Resources® (ESR), has joined the advisory board of CrimApollo, a provider of a unique online assessment process that helps employers use criminal record information in compliance with Equal Employment Opportunity Commission (EEOC) Guidance. ESR and CrimApollo are also working on a strategic relationship whereby ESR clients may utilize CrimApollo services. More information about the full CrimApollo Advisory Board is available at http://www.crimapollo.com/aboutus.php.
“Although each employment decision requires a case by case assessment of a number of factors, and software cannot make a decision, CrimApollo provides employers with a methodology to help ensure the fair use of criminal records in employment decisions and to demonstrate a good faith effort to follow Title VII and the new EEOC Guidance,” says Rosen. “This is a valuable tool that can be used by employers to analyze the risk factor in an employment decision where a criminal record is a consideration, along with other steps employers should consider to ensure a fair and non-discriminatory process.”
The President and Founder of CrimApollo, Derek Hinton, is a 30-year veteran in the employment screening industry, author of the ‘Criminal Records Manual,’ and founder of CRAzoom, a company assisting employment screening firms with National Association of Professional Background Screeners (NAPBS®) Accreditation. Developed with industry experts and veteran employment law attorneys, CrimApollo allows employers to assess the nature of the job, the offense, and obtain practical “job-related and consistent with business necessity” guidance while ensuring EEOC guidelines are followed and processes documented.
Members of the CrimApollo Advisory Board include the following background screening industry experts:
- Lester S. Rosen is an Attorney at Law and CEO of Employment Screening Resources (ESR). He is a frequent presenter nationwide on background checks and the Fair Credit Reporting Act (FCRA). He served as the chairperson of the steering committee that founded the NAPBS and served as its first co-chair. He has served as an expert witness in several cases involving negligent hiring. He is the author of ‘The Safe Hiring Manual – The Complete Guide to Employment Screening Background Checks for Employers, Recruiters, and Jobseekers’ (2nd Edition 2012/728 pages), the first comprehensive book on background checks.
- Michael Sankey is the CEO of BRB Publications, a major publisher of books and web content used by the employment screening and investigative industries. He has written or edited more than 60 print editions. The BRB web page at CRAHelpDesk.com provides extensive State compliance assistance to Consumer Reporting Agencies (CRAs) and Human Resources. Sankey was instrumental in the formation of the NAPBS, was a founding member, and served on the first NAPBS Board.
- Larry D. Henry is an attorney with the firm of Rhodes, Hieronymus, Jones, Tucker, and Gable in Tulsa, Oklahoma. He graduated with distinction from the University of Iowa College of Law in 1970. He has over 30 years of experience in FCRA and similar state consumer laws and is nationally recognized for his knowledge of consumer reporting matters. He has tried or assisted in FCRA and Drivers Privacy Protection Act (DPPA) litigation across the United States.
Criminal records have become indispensable for employers as a tool to ensure safe and productive workplaces for employees and the general public. Courts place an obligation on employers to ensure applicants are competent and fit for the position. At the same time, the EEOC prohibits certain practices when criminal records are used for employment purposes in accordance with their guidance. CrimApollo allows employers to assess the job and the offense while ensuring EEOC guidelines are followed.
