The U.S. House of Representatives has approved by voice vote the ‘Protecting Children from Sexual and Violent Predators Act’ (HR 2083) that would require state education agencies (SEAs) that receive federal funds under the Elementary and Secondary Education Act (ESEA) to require criminal background checks on school employees, according to a report on The National Association of State Budget Officers (NASBO) website at: http://www.nasbo.org/publications-data/washington-report/house-passes-bill-require-school-employee-background-checks.
According to NASBO, HR 2083 would also prohibit the employment of individuals convicted of certain crimes. SEAs would be required to include:
- Searches of the criminal registry or repository for each state in which the employee has resided.
- The child abuse and neglect registries and databases of such states.
- The FBI fingerprint check.
- The National Sex Offender Registry.
