Employers Need Caution with Background Check Laws

Written By Thomas Ahearn

home-applicant-generated-report-systemTo help employers understand background check laws and regulations, Attorney Lester Rosen, Founder and CEO of Employment Screening Resources® (ESR), will present a live 60 minute audio conference for AudioSolutionz titled ‘Extreme Caution Advised: Dealing with Federal and State Laws Regulating Pre-Employment Screening and Safe Hiring’ on Friday, March 7, 2014 at 10:00 A.M Pacific. For more information, visit http://www.audiosolutionz.com/hr-compliance-employment/safe-hiring.html.

“Employers have increasingly turned to pre-employment background screening as a risk management tool to avoid bad hiring decisions,” says Rosen, author of ‘The Safe Hiring Manual’ and a frequent speaker on due diligence issues. “However, no screening program can be conducted without a full understanding of a number of background check laws, including the Fair Credit Reporting Act (FCRA), discrimination and privacy law, the Americans with Disabilities Act (ADA), and state specific rules.”

In addition to these background check laws, Rosen says the U.S. Equal Employment Opportunity Commission (EEOC) has become more involved with background checks and issued updated ‘Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964’ that has the potential to change the way employers hire.  Attendees of the session will review the application of federal and state laws to pre-employment screening and also:

  • Understand how EEOC considerations impact screening tools such as credit reports, criminal records and social network sites.
  • Learn how the federal FCRA and similar state laws impacts hiring.
  • Review the elements and defenses to negligent hiring lawsuits.
  • Understand the dangers of using social media sites to select or recruit applicants.
  • Audit current practices for legal compliance.

The session is appropriate for hiring managers, employers, recruiters, staffing professionals, and supervisors. The speaker Rosen is Founder of Employment Screening Resources® (ESR), a nationwide background check company accredited by the National Association of Professional Background Screeners (NAPBS®).
