A class action lawsuit filed in New Jersey federal court that alleged that Canon Solutions America Inc. ran illegal background checks on their employees has reached a settlement agreement, according to a report on the Top Class Actions website. Top Class Actions reports the lead plaintiff filed the class action lawsuit for illegal background checks after she was allegedly fired by Canon in 2012 while transitioning from her temporary data-entry job to a full-time position. During the background check Canon allegedly ran on her, the lead plaintiff was asked if she had ever been convicted of a crime in the last seven years and she answered no she had not and was offered the position.
However, Top Class Actions reports that a few days into her new job the plaintiff was allegedly informed by Canon that she had failed the background check due to a felony allegedly committed 12 years earlier. She claims she was fired the same day and was not given a copy of her background check, a possible violation of the federal Fair Credit Reporting Act (FCRA) that regulates background checks for employment purposes.
Top Class Actions reports the plaintiff claims she would have explained to Canon that she was eligible to have the felony expunged if she given the chance to explain the circumstances surrounding her alleged felony. The class action lawsuit over illegal background checks also established a Class Period of two to five years before its December 2012 based on Canon’s electronic employee termination and job applicant rejection records.
