Attorney Lester S. Rosen, author of “The Safe Hiring Manual” and CEO of Employment Screening Resources® (ESR), will co-present the session “Compliance and Litigation: Working Effectively with Outside Counsel and Expert Witnesses” at the 2016 National Association of Professional Background Screeners (NAPBS®) Annual Conference from 4:00 p.m. to 4:50 p.m. on Tuesday, September 20, 2016, in Palm Desert, California. Joining Rosen as co-presenters of the session will be Attorney Ross D. Andre and Attorney Cindy D. Hanson from the law firm of Kilpatrick Townsend & Stockton LLP in Atlanta, Georgia. The NAPBS – “The Voice of Screening Professionals” – will hold the 2016 NAPBS Annual Conference at the JW Marriott Desert Springs Resort & Spa from September 18 to 20, 2016. Mr. Andre is an associate in the Complex Commercial Litigation group at Kilpatrick Townsend & Stockton. He focuses his practice on Fair Credit Reporting Act (FCRA) defense in class actions and individual cases. He has hands-on experience with all aspects of FCRA litigation, including trying an FCRA case to a jury verdict. Since 2014, he has taught the NAPBS Advanced FCRA Certification Course and has presented both at NAPBS conferences and in webinars.
Ms. Hanson focuses her practice on class action defense. She has handled hundreds of matters under the FCRA, including over a dozen class actions. Her practice includes the representation of Consumer Reporting Agencies (CRAs), entities who furnish information to CRAs, and employers who use background checks for employment purposes. In addition, she has significant experience representing companies defending class actions under consumer protection statutes and state common law.
Mr. Rosen founded Employment Screening Resources® (ESR) in the San Francisco, California area in 1997. He is also a frequent presenter nationwide on pre-employment screening and safe hiring issues including NAPBS conferences. He was the chairperson of the steering committee that founded the NAPBS, a not-for-profit trade association for the background screening industry, and served as the first co-chairman in 2004. He has also testified as an expert witness in court cases involving background checks.
According to a description of the NAPBS Annual Conference sessions: The screening industry is at a point where CRAs are routinely developing ongoing relationships with law firms that specialize in screening issues. Legal compliance and potential litigation have become focal points of the modern background screening industry. With ever-increasing legal regulation and litigation, background screening firms must have a game plan for dealing with compliance, claims, litigation, or government inquiries.
This session covers considerations for working with outside counsel, as well as expert witnesses, to both develop compliance and address claims. Topics include how to effectively select and partner with outside counsel and how your law firm can help prevent claims from being made or from escalating into more serious legal actions. It also covers the role of outside counsel and expert witnesses if a claim goes to litigation, as well as the role insurance plays in legal issues.
In addition to ESR CEO Rosen co-presenting a session at the NAPBS Annual Conference, ESR Vice President of Strategic Growth Dawn Standerwick is the incoming Chair-Elect for the NAPBS Board of Directors. She is a long time member of the NAPBS Board of Directors who is a seasoned industry professional with nearly 25 years of experience in all facets of workforce screening. She has extensive knowledge in background screening, drug testing, occupational health testing, and related HR technologies.
Employment Screening Resources® (ESR) is a founding member of NAPBS and has achieved Background Screening Credentialing Council (BSCC) re-accreditation by successfully demonstrating continued compliance with the Background Screening Agency Accreditation Program (BSAAP).
