Attorney Lester Rosen, founder and CEO of Employment Screening Resources® (ESR), will present a live webinar for Clear Law Institute entitled “The Use of Criminal Records by Employers: Staying Safe, Fair and Legal” on November 22, 2016, from 3:00 PM to 4:15 PM ET. To register for this webinar, visit http://clearlawinstitute.com/shop/webinars/the-use-of-criminal-records-by-employers-staying-safe-fair-and-legal/.

“There has been a seismic shift in legislation and regulations surrounding the use of criminal records by employers during background checks,” explains Rosen, the author of ‘The Safe Hiring Manual.’ “Companies that have not adjusted their policies risk lawsuits including expensive class actions. Creating a compliant use policy is a necessity for any company who performs criminal background checks.”

In this webinar, Rosen will teach attendees what their organizations can do to comply with the federal Fair Credit Reporting Act (FCRA) and the Equal Employment Opportunity Commission (EEOC) guidance on criminal records to help employers make sure their  background check process when hiring does not land them in court or under investigation. Among other things, attendees will learn about:

  • How the FCRA and state laws regulate the use of criminal records.
  • The impact of the EEOC Guidance on the use of criminal records.
  • What the “Ban the Box” movement is, why it is spreading, and how to prepare.
  • Which EEOC and Ban the Box laws should be in your policy on criminal records.
  • The steps you can take to avoid inaccurate results on criminal records.
  • How to audit current practices for legal compliance with criminal records.
  • A list of action items that can be implemented immediately at no cost.

The webinar on criminal records has been approved for 1.25 (General) recertification credit hours toward PHR, SPHR, and GPHR recertification through the HR Certification Institute (HRCI). Clear Law Institute is also recognized by Society for Human Resources Management (SHRM) to offer Professional Development Credits (PDCs) for the SHRM-CP or SHRM-SCP. This program is valid for 1.25 PDCs.
