Attorney Lester S. Rosen, founder and CEO of global background check firm Employment Screening Resources® (ESR) and author of “The Safe Hiring Manual,” will present a webinar for Business & Legal Resources (BLR) entitled “Ban the Box and Background Checks Update: How to Effectively Pre-Screen Prospective Job Candidates and Stay Within the Law” on Tuesday, July 25, 2017, from 1:30 p.m. to 3:00 p.m. Eastern/10:30 a.m. to 12:00 p.m. Pacific. To register for this event, click here.
Attendees of the live 90 minute webinar with Rosen will learn many states and localities have enacted Ban the Box laws prohibiting employers from requiring that applicants check a box on the application if they have been arrested for a criminal offense. Organizations using outside agencies to conduct background checks need to make sure they comply with the Fair Credit Reporting Act (FCRA) and federal laws prohibiting discrimination enforced by the Equal Employment Opportunity Commission (EEOC).
Rosen will reveal the latest updates on Ban the Box legislation and how to use background checks to screen prospective job candidates within legal bounds to avoid subjecting organizations to legal liability and costly penalties. Rosen will show the latest policy-based and procedural safeguards organizations should have in place so their hiring practices do not result in disparate impact or discrimination claims because of how they approached issues like the criminal history of applicants. Attendees will also learn:
- When questions related to criminal convictions may be asked and which are off limits.
- FCRA and EEOC rules to abide by when conducting employee background checks.
- How many years back organizations can go when doing background checks.
- The importance of individualized assessments to avoid discrimination claims.
The webinar “Ban the Box and Background Checks Update: How to Effectively Pre-Screen Prospective Job Candidates and Stay Within the Law” has been pre-approved for 1.5 hours of general recertification credit toward PHR and SPHR recertification from the HR Certification Institute (HRCI). BLR is recognized by the Society of Human Resource Management (SHRM) to offer Professional Development Credits (PDCs) for the SHRM-CP or SHRM-SCP. This program is valid for 1.5 PDCs for the SHRM-CP or SHRM-SCP.
“It’s common sense for employers to prescreen potential employees since they do not want any unwelcome surprises when the safety of your organization and your other employees is at stake,” explains Rosen. “And there are a number of background checks employers can legally perform to get a good idea of who they will hire.” Register now to secure a seat at this timely event that will provide vital insight and guidance on how to conduct effective background checks while staying within the law.
