The U.S. Department of Transportation (DOT) is reminding employers who perform DOT-regulated drug testing on job applicants to use the revised Federal Drug Testing Custody and Control Form (CCF) that was approved in 2017 after June 30, 2018, according to a notice from the DOT. The current CCF has been used under the DOT-regulated program since 2010. The revised CCF includes these changes:
- In Step 1D: Removal of the checkbox, the letters “DOT,” and hash line in front of the text “Specify DOT Agency”; and
- In Step 5A: Addition of four new analytes: oxycodone (OXYC), oxymorphone (OXYM), hydrocodone (HYC), and hydromorphone (HYM), and removal of the analyte methylenedioxyethylamphetamine (MDEA).
According to the DOT: On August 8, 2017, the Office of Management and Budget approved a revised Federal Drug Testing Custody and Control Form (CCF) and authorized the continued use of the `old CCF’ until June 30, 2018. DOT regulated employers and their service agents (collectors, laboratories, Medical Review Officers) may not use the `old CCF’ for DOT mandated drug test collections after June 30, 2018.
If the `old’ CCF is used after June 30, 2018, the collector, laboratory, Medical Review Officer (MRO), or employer implementing drug testing regulations must provide a signed statement that the incorrect form contains all information needed for a valid DOT drug test, the incorrect form was used by mistake or as means of conducting a test, and list steps taken to prevent future use of expired DOT forms.
For this drug testing flaw to be corrected, the test of the specimen must have occurred at an HHS-certified laboratory where it was tested consistent with the requirements of 49 CFR Part 40. This information must be supplied on the same business day of notification of the problem. If the correction does not take place, the drug test must be canceled. Employers or collectors may obtain the revised CCF by contacting their Department of Health and Human Services (HHS)-certified laboratory. A list of HHS‑certified laboratories can be found here. Collectors may use the electronic Custody and Control Form (eCCF) when the employer’s laboratory is approved through the HHS National Laboratory Certification Program to use a specific eCCF and the employer decided to use the eCCF, which must be updated to match the revised form using the eCCF Notice, eCCF Notice for Urine Specimen Collectors, and list of laboratories approved to use the eCCF.
