Attorney Lester S. Rosen, founder and Chief Executive Officer (CEO) of Employment Screening Resources® (ESR), will present a live webinar entitled “Avoiding Illegal Pre-Employment Screening Practices: Update on Background Checks, Ban the Box, Criminal Records, and Salary Secrecy Law” for continuing education provider Clear Law Institute on Wednesday, December 5th, 2018, from 12:00 PM to 1:30 PM Pacific Time.
Employers often find themselves caught in the middle of competing laws when it comes to effective hiring. On one hand, a “bad hire” can result in a legal and financial nightmare, including lawsuits for negligent hiring and workplace violence. On the other hand, background screening is increasingly regulated by state and federal legislation as a result of litigation over allegedly illegal practices.
As a result, employers must carefully navigate through the background screening process to not only avoid bad hires, but also prevent legal action by ensuring the rights of applicants were not violated. Attendees of the webinar hosted by Rosen – a noted background check expert who has spoken at numerous webinars and conferences for the “ESR Speaks” program – will be able to describe:
- What employers need to know about “Ban the Box” laws prohibiting questions about criminal records on initial job applications and restrictions on asking about past salary history.
- Other laws and best practices that impact hiring, background checks, and due diligence.
- How to ensure compliance with the federal Fair Credit Reporting Act (FCRA).
- Best practices for compliance with the U.S. Equal Employment Opportunity Commission (EEOC) and the EEOC’s enforcement guidance on discovering and using criminal records.
- The importance of implementing a process for the “Individualized Assessment” of criminal records.
- Cutting edge issues such as credit reports, social media, and ongoing criminal checks.
Rosen founded Employment Screening Resources® (ESR) in 1997 in the San Francisco, California area. He is the author of “The Safe Hiring Manual – The Complete Guide to Employment Screening Background Checks for Employers, Recruiters, and Jobseekers” (826 Pages/Facts on Demand Press/3rd Edition 2017), the first comprehensive book about employment screening.
Rosen was also the chairperson of the steering committee that founded the National Association of Professional Background Screeners (NAPBS) in 2003 and served as first co-chairperson. The NAPBS is a non-profit trade association established to represent the interest of member companies engaged in employment and tenant background screening across the United States.
