New York State Budget Includes Increase to OCA Statewide Criminal History Record Search Fee

On April 1, 2019, the New York Legislature approved the State Fiscal Year 2019-2020 budget that includes a $30 increase to the fee charged by the Office of Court Administration (OCA) for the statewide Criminal History Record Search (CHRS) to raise the cost for the NY OCA search from $65 to $95 (Fee increased on 4/13/2019).

The purpose of the increased fee for an OCA statewide criminal history record search from $65 to $95 – which will take effect when the budget is signed by New York Governor Andrew M. Cuomo – is to use the entirety of the additional $30 of the fee to fund indigent defense programs in New York state.

A message previously posted on the CHRS page of the NYCourts.gov website read: Please be advised that legislation has passed as part of the 2019/2020 New York State budget raising the cost of the criminal history record search conducted by OCA’s CHRS Unit from $65 to $95 per name and date of birth.

The message about the fee increase continues: The legislation increasing the fee is expected to take effect in the next several days when the Governor signs it. We will provide notification once the legislation is signed. Until then, the CHRS searches will still be $65 per name and date of birth search.

in addition, the New York OCA will ensure its criminal history record searches do not include an “undisposed case” for which there is no record of an executed warrant of arrest, superior court warrant of arrest, or bench warrant, and for which there is no record of conviction or imposition of any sentence or penalty.
