Attorney Lester Rosen, the founder and chief executive officer (CEO) of leading global background check firm Employment Screening Resources® (ESR), will present a webinar entitled “Criminal Records and Hiring – Is your Program Legal and Fair?” sponsored by AbideEdict from 12:00 p.m. to 1:30 p.m. PST on November 19, 2020.
“Hiring without understanding the legal way to obtain criminal records can land employers in hot water,” says Rosen. “While failure to exercise due diligence can result in an economic and legal nightmare, automatically or unfairly eliminating applicants with criminal records who pose little if any risk can also create liability.”
While conducting background checks is essential to minimizing negligent hiring liability, there has been a seismic shift in legislation and regulations surrounding the use of criminal records including “Ban the Box” laws and the U.S. Equal Employment Opportunity Commission (EEOC). Areas covered in the webinar by Rosen include:
- Learn how the federal Fair Credit Reporting Act (FCRA) and state laws regulate the use of criminal records.
- Understand the impact of the EEOC Guidance on the use of criminal records.
- Why Ban the Box is reaching a national tipping point and what employers can do to prepare.
- Steps to take to avoid inaccurate criminal results.
- Audit current practices for legal compliance.
“The use of criminal records and hiring has become both a complex, highly regulated, and controversial area for employers. Businesses need to avoid risk but at the same time understand that former offenders can make excellent workers and that automatic exclusion of ex-offenders can be unlawful,” explains Rosen.
Companies that have not adjusted their criminal record policies risk expensive class action lawsuits. The webinar with Rosen – author of “The Safe Hiring Manual” – will help employers navigate these complicated waters and deal with various demands.
