Ban the Box Laws that Go Overboard May Hurt Ex-Offenders and the Unemployed in 2015

Ban the Box laws, which protect ex-offenders from an “early knock out” punch in the hiring process based solely on the early disclosure of a criminal record, will quickly reach a tipping point in the U.S. in 2015. However, when these Ban the Box laws go too far the unintended consequence may well be that such laws actually hurt ex-offenders in the job market and can also hurt individuals who have been left unemployed by the recession. Whole Foods Faces Background Check Class Action Lawsuit

A class action lawsuit filed in a Florida federal court alleges that grocery store chain Whole Foods Market Group, Inc. performed illegal background checks on prospective and existing employees in violation of the federal Fair Credit Reporting Act (FCRA), according to an article on TopClassActions.com. Class action lawsuits for federal Fair Credit Reporting Act (FCRA) violations will increase in 2015 even if no one is actually harmed. In 2014, an increasing number of FCRA class action lawsuits were filed and were settled for millions of dollars and several more lawsuits were filed. FCRA violations can range from not making legally required disclosures to not following proper “adverse action” procedures. Employment laws in the United States will become more fragmented as cities and states continue to pass their own laws on hiring in 2015. These new laws will cover a wide variety of areas within the employment screening process including “Ban the Box” laws for job applications, criminal records, privacy on social media, and credit checks. The trend toward localization – particularly on the local, county, or city level – can have the effect of discouraging employers from setting up operations or hiring in places that place an undue burden on doing business.
