Lack of Criminal Background Checks by National Youth Organization Led To Alleged Sexual Abuse of Youths

The refusal of the Boy Scouts of America (BSA) to conduct criminal background checks on all volunteers until 2008 allowed convicted child sex offenders to join the organization and led to a significant amount of alleged sexual abuse of youths, according to a Los Angeles Times analysis of confidential BSA files. CFPB Warns Nationwide Specialty Consumer Reporting Agencies to Give Consumers Easy Access to Free Consumer Reports

The Consumer Financial Protection Bureau (CFPB) has released a bulletin to nationwide specialty consumer reporting agencies (NSCRAs) as a reminder of their obligation under the federal Fair Credit Reporting Act (FCRA), which the CFPB oversees, to provide a “streamlined process” for consumers to obtain a free annual consumer report. The CFPB also issued warning letters to NSCRAs that may be violating the FCRA by failing to provide consumers an easy way to access their free reports. Consumer Financial Protection Bureau Announces New Corrected Forms Required by FCRA for Background Checks Starting January 1 2013

In November 2012, the Consumer Financial Protection Bureau (CFPB) announced in the Federal Register corrections to typographical and technical errors in the earlier versions of three new essential CFPB forms required by the Fair Credit Reporting Act (FCRA) in the background screening process starting January 1, 2013. These forms include ‘A Summary of Your Rights Under the Fair Credit Reporting Act,’ ‘NOTICE TO USERS OF CONSUMER REPORTS: OBLIGATIONS OF USERS UNDER THE FCRA,’ and ‘NOTICE TO FURNISHERS OF INFORMATION: OBLIGATIONS OF FURNISHERS UNDER THE FCRA.’  The CFPB announcement is available at https://www.federalregister.gov/articles/2012/11/14/2012-27581/fair-credit-reporting-regulation-v-correction. Statistical Analysis of Online Ads for Internet Data Broker Website Uncovers Possible Racial Profiling

A Harvard University professor who ran a statistical analysis of online ads used by an Internet data broker website that suggested certain names may have arrest records uncovered what she described as possible racial profiling when she found the company’s advertising “disproportionately” used the word “arrested” for black-identifying names even when a person had no arrest record, according to the Huffington Post. Mobile App Developers Must Comply with California Online Privacy Protection Act by November 29

Effective November 29, 2012, all mobile application developers with “apps” available in California must be in compliance with the California Online Privacy Protection Act, according to a press release issued by  Attorney General Kamala D. Harris on October 30, 2012. The Attorney General formally notified up to 100 mobile app developers with ‘Notice of Non-Compliance with California Online Privacy Protection Act’ letters that they had 30 days to “conspicuously post a privacy policy within their app that informs users of what personally identifiable information about them is being collected and what will be done with that private information.” The press release is available at http://oag.ca.gov/news/press-releases/attorney-general-kamala-d-harris-notifies-mobile-app-developers-non-compliance. EEOC Performance and Accountability Report Under New Strategic Plan Shows Record High Monetary Recoveries for Discrimination Victims

The U.S. Equal Employment Opportunity Commission (EEOC) has announced record high monetary recoveries for victims of discrimination for Fiscal Year (FY) 2012 – more than $365 million – in its first Performance and Accountability Report (PAR) compiled under the standards of the EEOC’s new Strategic Plan.
