EEOC Issues Performance Report for Fiscal Year 2014

The U.S. Equal Employment Opportunity Commission (EEOC) has issued its annual Performance and Accountability Report (PAR) for Fiscal Year (FY) 2014 that ended on September 30, 2014. The PAR report showed the EEOC – the federal agency that enforces laws enforces federal laws prohibiting employment discrimination – secured nearly $300 million in monetary relief for victims of employment discrimination. The Federal Trade Commission (FTC) has issued a follow-up guide – Background Checks – Tips For Job Applicants and Employees – that expands on a March 2014 joint publication of the Equal Employment Opportunity Commission (EEOC) and the FTC: Background Checks: What Job Applicants and Employees Should Know. The new guide further specifies the rights of applicants and employees under the federal Fair Credit Reporting Act (FCRA) and anti-discrimination laws when employers run background checks. Bill Seeks To Limit EEOC Guidance on Criminal Background Checks

New legislation – The “Certainty in Enforcement Act of 2014” (H.R. 5423) – seeks to limit the current U.S. Equal Employment Opportunity Commission’s (EEOC) enforcement guidance on criminal background checks and “amend Title VII of the Civil Rights Act of 1964 to exclude the application of such title to employment practices that are in compliance with Federal regulations, and State laws, in certain areas.” The full text of H.R. 5423 – which could possibly affect EEOC guidance enforcement if passed – is available at http://www.gpo.gov/fdsys/pkg/BILLS-113hr5423ih/pdf/BILLS-113hr5423ih.pdf.
