Millennials in Workforce Will Make Employers Change Methods of Background Screening Job Applicants

Population estimates from the U.S. Census Bureau have found that Millennials – defined as people aged 18 to 34 in 2015 – numbered 75.4 million and in 2015 surpassed the 74.9 million Baby Boomers aged 51 to 69, according to a Pew Research Center article. The fact that Millennials have overtaken Baby Boomers as the largest segment of the U.S. workforce and are making employers change their methods of background screening for job applicants is Trend Number 7 in the Employment Screening Resources® (ESR) 10th annual ‘ESR Top Ten Background Check Trends’ for 2017. FCRA Lawsuits Will Remain a Potential Threat to Employers After Supreme Court Decision in Spokeo Case

On May 16, 2016, the Supreme Court of the United States ruled in the case of Spokeo, Inc. v. Robins that consumers must prove “concrete injury” in class action lawsuits for alleged “bare” violations of a federal statute. However, the fact that class action lawsuits involving the federal Fair Credit Reporting Act (FCRA) that governs background checks in the U.S. will remain a potential threat to employers despite recent court rulings dismissing FCRA lawsuits and citing the Spokeo decision as the reason is Trend Number 8 in the Employment Screening Resources® (ESR) 10th annual ‘ESR Top Ten Background Check Trends’ for 2017. Drug Testing in Workplace Will Have to Deal with Growth of State Laws Allowing Use of Marijuana

As of November 2016, a total of 28 U.S. states, the District of Columbia, Guam, and Puerto Rico allow for comprehensive public medical marijuana and cannabis programs, according to the National Conference of State Legislatures (NCLS) website. Some states have also passed laws allowing for the recreational use of marijuana by adults.
