USCIS to Publish Revised Form I-9 by November 22

The U.S. Citizenship and Immigration Services (USCIS) has announced that a revised version of the Form I-9, Employment Eligibility Verification will be published by November 22, 2016. Employers may use the current version of the Form I-9 with a revision date of 03/08/2013 N until January 21, 2017. After January 21, 2017, all previous versions of Form I-9 will be invalid. In the Final Decision and Order in the case of U.S. v. Golden Employment Group, Inc., 12 OCAHO nos. 1274 and 1277 (2016), the Office of the Chief Administrative Hearing Officer (OCAHO) found a staffing company liable for 465 Form I-9 violations resulting in civil penalties in the total amount of $209,600. USCIS Tells Employers to Continue to Use Current Form I-9 Until New Version Released

The U.S. Citizenship and Immigration Services (USCIS) has published a 30-day notice in the Federal Register inviting public comment on proposed changes to the current Form I-9, Employment Eligibility Verification. The USCIS also told employers to continue to use the current Form I-9 until the new version is released even though the current Form I-9 displays “Expires 03/31/2016” in the upper right hand corner. A company was fined more than $600,000 after the Office of the Chief Administrative Hearing Officer (OCAHO) issued a decision finding the employer liable for more than 800 Form I-9 violations of hiring employees to work in the United States without properly examining and documenting their identity.
