Attorney at Law and background check expert Lester Rosen, founder and President of Employment Screening Resources (ESR), shows Consumer Reporting Agencies (CRAs) how to stay out of legal hot water and avoid lawsuits and legal fees in an educational session ‘Staying Out of Court! Critical Considerations for Every Screening Firm’ at the 2011 National Association of Professional Background Screeners (NAPBS®) Annual Conference in Denver, Colorado on Monday, March 21, 2011.

“Since background screening has numerous moving parts, background screening firms need to be careful and not be a moving target for lawsuits,” says Rosen, author of  ‘The Safe Hiring Manual – The Complete Guide to Keeping Criminals, Terrorists, and Imposters Out of Your Workplace,’ the first comprehensive book on employment screening. “CRAs need to learn to minimize risks or risk being put out of business.”

In the educational session, Rosen – a frequent speaker nationwide on the topic of safe hiring – surveys a number of areas where background screening firms may have exposure to lawsuits, from legal compliance and privacy issues to how criminal records are reported and general business practices. Attendees play judge as cases where background screening firms have been sued are reviewed. Other topics covered in the session include:

  • Who Can Sue CRAs
  • Trends to More Liability
  • Critical Considerations for CRAs
  • Proper Use of Criminal Databases
  • CRA Liability for Court Researchers
  • Cause of Action for Inaccurate Reports
  • Over and Under Reporting Criminal Results
  • Fair Credit Reporting Act (FCRA) Requirements
  • Equal Employment Opportunity Commission (EEOC) Issues

On Tuesday, March 22, 2011, Rosen will take part in a panel of background screening industry experts discussing ‘How to Handle Complicated Disputes’ at the conference to explore various candidate dispute scenarios and actual situations and how they are handled by CRAs and attorneys. Rosen was also the chair of the steering committee that founded NAPBS, a non-profit trade association representing background screening firms, and served as first co-chair.

The 2011 NAPBS Annual Conference – ‘Navigating the Legislative and Regulatory Landscape’ – is being held from March 20-22, 2011 at the Hyatt Regency Denver in Denver, Colorado. For more information, visit NAPBS at
