“If you don’t already run background checks, you should,” says Callahan, who works with employers to conduct background checks and teaches them about legal compliance efforts across the fifty U.S. states “It’s an opportunity to investigate whether applicants have lied, stolen, cheated, been violent, or otherwise engaged in unacceptable behavior. It’s also a way to defend against a negligent hiring claim in the event you hire someone with a clean slate who later takes a turn for the dark side.”

Fortunately for employers, Callahan says there are many tools they can legally use to conduct thorough background checks on job applicants. But they need to know the legal parameters within which they can “dig for dirt.” Also, it’s important for employers to know the procedures to follow once they decide they are not going to hire an applicant because of information uncovered to avoid being vulnerable to failure-to-hire bias claims.
