To help businesses remain in compliance with the U.S. Equal Employment Opportunity Commission (EEOC) guidance on use of criminal background checks, Employment Screening Resources (ESR), a nationwide background check firm accredited by the National Association of Professional Background Screeners (NAPBS®), will provide its clients with the ESR Assured ComplianceSM system for EEOC criminal guidance at a special “client only” webinar hosted by ESR founder and CEO Attorney Lester Rosen – ‘Practical Steps Employers Can Take Today to Comply with the New EEOC Criminal Guidance’ – on May 31, 2012 from 11 AM to 12 PM Noon Pacific Time. Information on how ESR clients may register for the webinar is available at: https://www.esrcheck.com/Newsletter/ESR-Speaks/Practical-Steps-Employers-Can-Take-Today-to-Comply-with-the-New-EEOC-Criminal-Guidance-139/. “Although there are additional considerations for employers using criminal background checks, rather than just repeating the EEOC guidance language Employment Screening Resources is giving clients the ESR Assured ComplianceSM system for EEOC compliance solutions,” says Rosen, the author of ‘The Safe Hiring Manual’ and a background check expert. “For ESR clients only, we are having a webinar on May 31 about the updated EEOC guidance and will provide compliance templates. For non-clients, we will have a second webinar two weeks later for the general public.” In addition to the “client only” webinar on May 31, which will contain special ESR Assured ComplianceSM system information available only to ESR clients, Employment Screening Resources (ESR) will present a second webinar on the new EEOC Guidance open to the general public hosted by CEO Rosen on Thursday, June 14, 2012 from 11 AM to 12 Noon Pacific Time. To register for the ESR public webinar on the EEOC Criminal Guidance, visit: https://www2.gotomeeting.com/register/781044434. (ESR CLIENTS ONLY: Please register for the “client only” webinar on EEOC Guidance on May 31, 2012 by visiting: ESR CLIENT ONLY WEBINAR ON EEOC GUIDANCE.) On April 25, 2012, the EEOC, the agency that enforces federal laws prohibiting employment discrimination, voted to approve updated Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964. In the May 31 webinar, Rosen will offer “real world” solutions on what employers should do now to remain in compliance with the EEOC while performing criminal background checks.  Topics covered in the webinar ‘Practical Steps Employers Can Take Today to Comply with the New EEOC Criminal Guidance’ include:

  • Longstanding court decisions and existing EEOC Guidance documents;
  • Employment discrimination based on race and national origin, criminal records, and employer practices;
  • The differences between arrest and conviction records;
  • Disparate treatment and disparate impact analysis under Title VII;
  • Employer defenses the EEOC believes meet the “job related and consistent with business necessity” standard;
  • Individualized assessment of job applicants with criminal records;
  • Compliance with other federal laws and/or regulations that conflict with Title VII;
  • State and local laws or regulations preempted by Title VII;
  • EEOC Guidance best practices for employers; and
  • Links to EEOC Guidance materials and Q & A.
“Assuming that the current EOCC guidance continues to be the position of the EEOC, employers need an action plan to comply with the new rules,” says Rosen, a frequent speaker nationwide on due diligence issues for the ‘ESR Speaks’ program. “The ESR Assured ComplianceSM system offers flexible compliance templates with potential paths employers may consider to find the best fit for their business.” After registering for the webinars, registrants will receive a confirmation email containing information about joining the webinars. For ESR clients unable to attend the webinar on that date, an on demand version of the recorded “client only” webinar will be made available to them the following day. A recorded version of the public webinar will also be made available the following day. Rosen recently submitted a letter of public comment to the EEOC regarding the April 2012 meeting where the EEOC voted 4-1 to approve updated Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964.
