Attorney and safe hiring expert Lester Rosen, Founder and CEO of nationwide accredited background check firm Employment Screening Resources (ESR), was recently interviewed by Tom Field, Vice President of Editorial with Information Security Media Group, about the 6th annual ESR ‘Top 10 Background Check Trends for 2013.’ The interview with Rosen revealed a new emphasis on the accuracy of information in reports and use of criminal records by employers. In April 2012, the U.S. Equal Employment Opportunity Commission (EEOC) – the agency that enforces federal laws prohibiting employment discrimination – issued new Enforcement Guidance on how organizations should use criminal background checks. Rosen says one of the key trends to watch in 2013 will be how the new EEOC Guidance on the use of criminal records changes the way organizations approach employment screening.

“Eventually, those new rules will probably revolutionize the way American employers hire… in terms of application forms, in terms of how past criminal convictions should be used,” says Rosen, author of ‘The Safe Hiring Manual,’ the first comprehensive guide to employment screening that he recently updated for an expanded 2nd edition published in October 2012.  “That’s a big game-changer,” he adds.

Among other top screening trends for 2013 are the movement toward greater accuracy in background checks and new sentiment to “ban the box” that asks applicants to check a box on employment applications if they have past criminal convictions. In the interview about top trends, Rosen discusses highlights of the list effective ways to use criminal background checks, and the “do’s and don’ts” of social media screening. The list of top trends is available at

Rosen has selected 10 background check trends to follow in the coming year:

ESR has compiled ‘Top Ten Background Check Trends’ since 2008. Rosen selects trends after reviewing developments from various sources that include evolving hiring practices and demographics, legal cases concerning background checks, advancements in screening technology, new government regulations for screening at the federal and state level, and questions and concerns regarding background checks.
