In April 2012, the U.S. Equal Employment Opportunity Commission (EEOC) – the agency that enforces federal laws prohibiting employment discrimination – issued new Enforcement Guidance on how organizations should use criminal background checks. Rosen says one of the key trends to watch in 2013 will be how the new EEOC Guidance on the use of criminal records changes the way organizations approach employment screening.

“Eventually, those new rules will probably revolutionize the way American employers hire… in terms of application forms, in terms of how past criminal convictions should be used,” says Rosen, author of ‘The Safe Hiring Manual,’ the first comprehensive guide to employment screening that he recently updated for an expanded 2nd edition published in October 2012.  “That’s a big game-changer,” he adds.

Among other top screening trends for 2013 are the movement toward greater accuracy in background checks and new sentiment to “ban the box” that asks applicants to check a box on employment applications if they have past criminal convictions.
