Rosen warns that if screening is not done right, employers can be sued since background checks are governed by litigation, regulation, and legislation. Employers could face class action lawsuits for not following the federal Fair Credit Reporting Act (FCRA) or for “negligent hiring” for failure to perform background checks. New Equal Employment Opportunity Commission (EEOC) Guidance for use of criminal records and laws on use of credit reports, social media, and offshoring have also changed how employers hire.
