Attorney Lester Rosen, Founder and CEO of San Francisco-area background check firm Employment Screening Resources® (ESR), will present a live California Employer Advisor (CEA) webinar titled ‘Background Checks in California: How To Comply with the EEOC’s Recently Issued Enforcement Guidance’ on Tuesday, April 30, 2013 from 10:30 a.m. to 12:00 noon Pacific. The webinar is available exclusively to CEA online subscribers at no cost. Non-members interested in the webinar may sign up for a membership. For more information, click here.

“While conducting thorough background checks is essential, both for your peace of mind and to prevent against negligent hiring or retention claims, there’s a fine line between smart sleuthing and infringing on an applicant’s privacy rights,” says Rosen, author of ‘The Safe Hiring Manual.’

Rosen will host the in-depth webinar specifically for California employers and will explain exactly what employers in the Golden State need to know, including how new U.S. Equal Employment Opportunity Commission (EEOC) enforcement guidance affects their hiring process. Participants will learn:

  • The proper timing of background checks – when during the hiring process employers should begin background screening and how deviating from established policy could spark legal claims.
  • Best practices for evaluating arrest and criminal conviction records in light of recently issued EEOC enforcement guidance.
  • Questions to ask third-party employment screening providers before employers retain them to protect their organization from potential liability.
  • The four steps employers must take before checking credit, criminal records, or other matters so they are in compliance with the federal Fair Credit Reporting Act (FCRA).
  • Best practices for giving notice, getting authorization, handling pre-adverse action, and adverse action procedures.
  • How employers can avoid the temptation of overstepping their bounds when conducting social media searches on job candidates.
  • Tips on how to develop a legally defensible background check screening process.

The CEA webinar has been approved for 1.5 recertification credit hours toward PHR and SPHR recertification through the Human Resource Certification Institute (HRCI) and also a California-specific continuing education activity for PHR-CA and SPHR-CA recertification. The 75-minute presentation will be followed by 15 minutes of Q & A. Non CEA Online members interested in the webinar can sign up for a full year of membership that includes 12 subscriber-only webinars each year.
