On July 1, 2013, the final phase of laws passed in Georgia and North Carolina – Georgia House Bill 87, the “Illegal Immigration Reform and Enforcement Act of 2011” and North Carolina Session Law 2011-263 House Bill 36 – take effect and mandate the use of E-Verify for most private companies in those states. Georgia employers with more than ten employees and North Carolina employers with more than twenty five employees must begin using the E-Verify employment eligibility verification program to check work authorization for all new hires. Georgia H.B. 87, the “Illegal Immigration Reform and Enforcement Act of 2011” phased in mandatory E-Verify usage for private businesses in three stages. Employers with 500 or more employees had to use E-Verify by January 1, 2012 and employers with 100 or more employees but fewer than 500 had to use E-Verify by July 1, 2012. Employers with between 11 and 99 employees must use E-Verify for new hires on or before July 1, 2013. Private employers in Georgia with 10 or fewer employees are exempt from the law. The E-Verify legislation in North Carolina also became effective in three phases. Employers with 500 or more employees were required to use E-Verify by October 1, 2012 while employers with 100 or more employees were required to use E-Verify by January 1, 2013. Employers with 25 or more employees will be required to use E-Verify by July 1, 2013. The North Carolina Department of Labor (NCDOL) is charged with investigating complaints for violations of the E-Verify law.
