California Governor Jerry Brown has signed a new law – Assembly Bill 465 (AB 465) – to help protect children who participate in community youth athletic programs from sexually abusive and violent individuals by creating a consistent criminal background check policy across the state for volunteer coaches in youth sports. Co-authored by Assemblywoman Susan Bonilla (D-Concord) and Assemblyman Brian Maienschein (R-San Diego), AB 465 “clarifies that all community sports programs in California are authorized to administer criminal background checks on volunteer coaches and also authorizes such programs to request subsequent arrest notifications from the Department of Justice,” according to a news release available on Assemblywoman Bonilla’s website at

AB 465 will amend Section 11105.3 of the Penal Code, relating to criminal history. While existing law requires “mandated reporters” – as defined on The Child Abuse Mandated Reporter Training Project at – to report child abuse and neglect to local law enforcement, AB 465 would state that performing the background check does not remove or limit the liability of a mandated reporter.
