“The EEOC issued a new guidance in April 2012 on the use of criminal records in hiring decisions that has the potential to totally change how every employer in America approaches hiring,” says Rosen, author of ‘The Safe Hiring Manual,’ a guide to background checks. “The EEOC has filed lawsuits and investigated employers for practices that allegedly created a ‘disparate impact’ by the use of criminal records.”

On April 25, 2012, the EEOC issued ‘Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964.’ The EEOC enforces federal laws prohibiting employment discrimination under Title VII, which prohibits employment discrimination on the basis of race, color, religion, sex, or national origin.
