On April 25, 2012, the EEOC approved updated Enforcement Guidance on the Consideration of Arrest and Conviction Records in Employment Decisions Under Title VII of the Civil Rights Act of 1964. This EEOC Guidance has impacted how employers in America hire and CRAs perform background checks. The webinar on EEOC Guidance Best Practices will feature three presenters familiar with the EEOC Guidance:
- Lester S. Rosen, Attorney at Law, Founder & CEO Employment Screening Resources (ESR).
- Fred Giles, CPP CARCO Group, Inc.
- Lewis Maltby, Attorney at Law, President of the National Workrights Institute.
The hour long EEOC Guidance webinar will focus on a report Rosen, Giles, and Maltby helped develop titled ‘Best Practice Standards: The Proper Use of Criminal Records in Hiring’ that addresses the use of criminal records during employment background checks. This report was prepared by the Lawyers’ Committee for Civil Rights Under Law, the National H.I.R.E. Network, and the National Workrights Institute and is available at https://www.esrcheck.com/file/Best-Practice-Standards-Criminal-Records.pdf.
The EEOC Guidance webinar will introduce 15 recommended best practice standards from the report for the use of criminal records by employers that are a “must have” for every CRA. These standards are widely circulated and employers are using the information to design background screening programs. The standards have received approval of important government agencies and some cover how employers should select and work with background screening firms.
