The U.S. Citizenship and Immigration Services (USCIS) has announced that all E-Verify transaction records more than ten years old will be deleted from the system effective January 1, 2016, to comply with the retention and disposal schedule of the National Archives and Records Administration (NARA).

According to a “Fact Sheet,” USCIS disposes of E-Verify records over 10 years old every January 1 in accordance with the NARA records retention and disposal schedule N 1-566-08-7 to minimize security and privacy risks associated with U.S. Government retention of Personal Identifiable Information (PII).

In order to retain case information, employers who have used E-Verify for more than 10 years may download and save the new “Historic Records Report” from October 1, 2015, through December 31, 2015, by following the NARA Instructions to Download Historic Records Reports in E-Verify.

USCIS encourages the best practice of recording the E-Verify case verification number on the relating Employment Eligibility Verification, Form I-9 and also retaining the Historic Records Report with the corresponding Forms I-9. For more guidance, see “NANA Initiative Questions and Answers.”

Employers who were not using E-Verify on or before December 31, 2005, do not need to download the “Historic Records Report” since there will be no records to report. According to the USCIS – the agency overseeing lawful immigration to the United States – E-Verify is currently used by 600,000 U.S. employers.

E-Verify is an Internet-based system that compares information from the Form I-9 filled out by workers to data from U.S. Department of Homeland Security (DHS) and Social Security Administration (SSA) records to confirm employment eligibility. To learn more, visit
