Job seekers with criminal records face many challenges when re-entering the workforce. To help these reformed ex-offenders find employment, the Privacy Rights Clearinghouse (PRC), a California nonprofit corporation helping individuals protect their privacy, has posted an article titled “Ten Critical Steps for Ex-Offenders to Get Back Into the Workforce” by safe hiring expert Attorney Lester Rosen, the founder and CEO of San Francisco, CA-area background check firm Employment Screening Resources (ESR).

In the article, Rosen explains how ex-offenders are in a frustrating “Catch-22” situation when seeking work: If a person lies, then they are always at risk of being terminated if the criminal record is discovered later. If a person is honest and admits the past misconduct, there is a substantial risk of not even getting a chance to compete for the job. The fear is that upon learning about a past criminal conviction, the employer will simply trash can the employment application or stop considering the applicant at all.

Rosen – the author of “The Safe Hiring Manual,” the first comprehensive guide to background checks – offers ten steps that a job seeker with a past criminal record can consider when seeking employment. The steps include seeing if a conviction is eligible to be sealed, expunged, or judicially set aside, as well as understanding their rights under the federal Fair Credit Reporting Act (FCRA) and state laws if information in their criminal record background check is being used against them.

Rosen notes that while there are numerous challenges facing ex-offenders in obtaining employment, “challenging is not the same as impossible.” He offers case studies of ex-offenders who were frustrated by their work situation but who eventually turned their lives around by being patient, taking the long view, and believing things would get better.
