Since negligent hiring is one of the fastest growing areas of employment litigation, Attorney Lester Rosen, Founder and CEO of Employment Screening Resources® (ESR), will present a live webinar for entitled ‘Negligent Hiring and Background Checks – Best Practices and Legal Compliance’ on Wednesday, January 27, 2016 from 1:00 PM to 2:30 PM EST (10:00 AM to 11:30 AM PST).

“To avoid bad hiring decisions, employers are utilizing background checks as a risk management tool,” says Rosen, author of ‘The Safe Hiring Manual.’ “However, background checks are increasingly subject to litigation, legislation, and regulation. There has been an explosion of class action lawsuits as well as actions by federal agencies based on allegations that employers failed to follow the law.”

During the 90 minute webinar, Rosen – a noted expert on employment background checks – will audit ten key areas of legal compliance designed to help employers hire the best while avoiding legal fallout. Attendees will learn legally complaint best practices to keep a business productive and out of court, including how to obtain and utilize criminal record and background information on job applicants.

Rosen will update attendees on recent legal developments regarding background checks and review case studies to demonstrate what steps employers should take and mistakes to avoid. He will also cover cutting edge issues such as the use of social media background checks and the U.S. Equal Employment Opportunity Commission (EEOC) approach to the use of criminal records by employers. Attendees will:

  • Learn why background checks and due diligence have become mission critical for employers.
  • Understand the basics of a negligent hiring lawsuit and defenses that work and do not work.
  • Learn how to spent fraudulent employment and education credentials.
  • Learn steps to implement a legally compliant program and to hire the best employees.
  • Learn how the federal Fair Credit Reporting Act (FCRA) and state laws impacts hiring.
  • Review the elements and defenses to negligent hiring lawsuits.
  • Understand the current explosion in class action lawsuits related to background checks.
  • Audit your current practices for legal compliance.

“Employee problems are caused by problem employees, and this course will help HR professionals avoid bad hires in the first place by practicing due diligence background checks in their hiring programs,” says Rosen. “Employers will get updated on federal and state laws, lawsuits and regulations controlling pre-employment screening background checks, and audit their current practices for legal compliance.”

The webinar ‘Negligent Hiring and Background Checks – Best Practices and Legal Compliance’ has been approved by the HR Certification Institute (HRCI) as eligible for 1.50 credits towards a participant’s recertification upon full completion.
