Attorney Lester Rosen, founder and CEO of Employment Screening Resources (ESR), will present a live webinar for Compliance Online entitled “The Federal Fair Credit Reporting Act (FCRA) and Background Checks” on Thursday, May 19, 2016, at 11:00 AM PDT / 2:00 PM EDT. To register, please visit

“Employers have long recognized that conducting due diligence background checks on new hires is a mission critical task,” explains Rosen. “Firms cannot afford to be sidetracked by employee problems such as workplace violence, theft, false resumes, embezzlement, or trumped-up injury claims. Employers can be sued for negligent hiring if they hire someone they should have known, through the exercise of due diligence, was dangerous, unfit, dishonest or unqualified.”

Rosen – author of “The Safe Hiring Manual” – will explain how the FCRA affects the background checks of job applicants. Rosen will also discuss FCRA regulations that employers should comply with while conducting background checks to avoid getting into legal issues in future. Participants will learn about FCRA best practices and regulatory requirements regarding background checks and investigation for safe hiring. Other areas covered in the webinar include:

  • Basic operation of the FCRA for employers.
  • Impact of Federal Trade Commission (FTC) staff opinion letters.
  • FCRA class action lawsuits rising in 2015.
  • States having their own version of the FCRA.
  • How to comply with the complex law known as FCRA.

Originally passed in 1970, the FCRA regulates how employers conduct pre-employment background checks of employees. Any employer, Human Resources professional, or security official involved in pre-employment background checks must comply with this complex law. However, the FCRA is full of potential legal landmines that can expose unwary employers to liability. In addition, at least 27 states have their own version of the FCRA.

The webinar “The Federal Fair Credit Reporting Act (FCRA) and Background Checks” has been pre-approved by the Society for Human Resource Management (SHRM) as eligible for 1.25 credits and the HR Certification Institute (HRCI) as eligible for 1.50 credits towards recertification. To register, visit
