On February 1, 2017, Kentucky Governor Matt Bevin issued an executive order that will “Ban the Box” and remove questions about criminal conviction history from the initial application for all state jobs in the executive branch, according to a news report on Governor Bevin’s website.

Under the Ban the Box order – also known as the “Fair Chance Employment Initiative” – applicants will not be required to check the box on the initial state job applications that asks them if they have any criminal convictions and will also give convicted felons a chance at meaningful employment.

“The simple act of removing this box will help to level the playing field for all applicants, and it is my sincere hope that many of the private employers in our state will consider doing the same thing,” said Governor Bevin stated in the press release about the Kentucky Ban the Box order.

Governor Bevin stressed the importance of Ban the Box to remove barriers for felons to become employed which helps reduce recidivism and improve public safety. Postponing that inquiry until after the initial application provides applicants with a better opportunity to explain their backgrounds.

The Ban the Box order will still allow executive branch agencies to still inquire about criminal records before interviewing applicants and to consider criminal history when making hiring decisions. The Ban the Box Executive Order took effect immediately. A copy can be downloaded here.

According to the National Employment Law Project (NELP), more than 150 cities and counties as well as 25 states have adopted Ban the Box policies to help the estimated 70 million people in the United States with a prior arrest or conviction record have a fair chance at employment.
