On November 6, 2017, Arizona governor Doug Ducey issued Executive Order 2017-07 to adopt new “Ban the Box” hiring procedures to provide a second chance and increased job opportunities to Arizonans who have served their time and been released, according to a news release on the Governor’s website.
Under the new Ban the Box policy – also known as the “Second Chance Box” – Arizona state agencies will delay questions about the criminal record of applicants for state employment until after the initial stages of interviewing to ensure all individuals receive full and fair consideration for job openings.
“All Arizonans – no matter their background or past mistakes – deserve the chance to make a living and a better life for themselves and their families,” Governor Ducey said in the news release. “If you served your time and paid your debt to society, you should have the opportunity at a real second chance.”
The Executive Order directs the Department of Administration to establish hiring procedures that will be used by all state agencies. Under the Ban the Box policy, state agencies will not ask about an applicant’s criminal record until an applicant has submitted an application and received an initial interview.
An estimated 1.5 million Arizona adults have arrests or convictions on their records. The Ban the Box order also points out that ex-offenders who find employment following their release from jail are less likely to end up back in prison, saving taxpayer resources and boosting Arizona’s economy.
The “Ban the Box” movement is named for the box on most job applications that applicants are asked to check if they have a criminal record. Ban the Box delays the criminal history question until later in the hiring process so ex-offenders have a chance to show their knowledge, skills, and abilities to do a job.
Nationwide, 29 states besides Arizona and more than 150 cities and counties have Ban the Box laws that delay the criminal history question, according to the National Employment Law Project (NELP), which estimates the number of Americans with criminal records to be approximately 70 million people.
