In this introductory webinar, attendees will learn the basics of pre-employment background checks. To avoid bad hiring decisions, employers are utilizing background checks as a risk management tool. Just one bad hire can create a significant and financial nightmare, including lawsuits for negligent hiring, theft, workplace violence, and having unqualified workers on the job.
However, background checks are increasingly subject to litigation, legislation, and regulation. There has been an explosion of class action lawsuits as well as actions by federal agencies based on allegations that employers failed to follow the law. This course will first review the fundamentals of background checks and negligent hiring. Areas covered in the session will include:
- Learning why background checks and due diligence have become mission critical for employers.
- Understanding the basics of a negligent hiring lawsuit and defenses that work and do not work.
- Learning the basics of background checks including why and how they are done.
- Learning steps your organization can take today to implement a legally compliant program and to hire the best employees.
- Learning how the federal Fair Credit Reporting Act (FCRA) and state laws impact screening and legal requirements for background checks.
- Understanding the current explosion in class action lawsuits related to background checks.
The other three webinars in the series are Legally Obtaining and Using Criminal Records, and the Impact of the EEOC and Ban the Box on April 11, 2018, from 2:00 PM to 3:30 PM ET, Verifying Employment, Education, and Credentials on May 30, 2018, from 2:00 PM to 3:30 PM ET, and The Legal Use of Social Media, Credit Reports, Driving Records, and International Screening in Hiring on June 28, 2018, from 2:00 PM to 3:30 PM ET.
Upon completion of the four-part curriculum – either by attending the live webinar or by listening to a recorded version – participants will be recognized for successfully completing a course of professional study with a “Certificate of Completion of a Course of Study for Background Checking Essentials” that represents a professional commitment to continual learning and skill development in this field.
The four courses are 90 minutes each and worth 1.5 recertification credits for both the HR Certification Institute (HRCI) and Society for Human Resource Management (SHRM). Participation in each course will lead to a Certificate of Completion that identifies participants as having completed an educational course of study in the critical areas of due diligence, legal compliance, and background checks.
Rosen is the author of “The Safe Hiring Manual,” the first comprehensive book on background checks, and “The Safe Hiring Audit.” He is a frequent presenter nationwide on pre-employment screening and safe hiring issues with speaking appearances at numerous national and statewide conferences. He has qualified and testified in the Superior Courts as an expert witness on issues surrounding due diligence.
