To avoid bad hiring decisions and lawsuits for negligent hiring, employers often utilize checks on criminal records. Human Resources (HR) professionals need to understand the complexities involved, such as discrimination issues and the role of the U.S. Equal Employment Opportunity Commission (EEOC), Ban the Box and Fair Chance Hiring laws, state laws limiting the use of criminal records, and the need for re-entry programs.
In addition, due to record low unemployment, many employers have discovered the viability of considering ex-offenders for appropriate positions and how to approach the use of criminal records in hiring.
