To avoid bad hiring decisions and lawsuits for negligent hiring, employers often utilize checks on criminal records. Human Resources (HR) professionals need to understand the complexities involved, such as discrimination issues and the role of the U.S. Equal Employment Opportunity Commission (EEOC), Ban the Box and Fair Chance Hiring laws, state laws limiting the use of criminal records, and the need for re-entry programs.
