Attorney Lester Rosen, founder and chief executive officer (CEO) of leading global background check firm Employment Screening Resources® (ESR), will present a live webinar titled “Screening Unemployed Job Applicants: Pros and Cons to Consider” hosted by compliance training provider Lorman Education Services on Monday, March 30, 2020, from 10:00 AM to 11:30 AM Pacific Standard Time (PST).
The webinar will help employers deal with the legal and practical issues involved with using employment history as a barometer for evaluating applicants. Many job applicants find themselves at a disadvantage if they are currently unemployed or have significant gaps in their employment history. Employers may be concerned that unemployment reflects poorly on an applicant’s ability or fitness for the job.
However, such an approach can also adversely impact workers who are unemployed through no fault of their own or left the workforce for legitimate reasons such as caring for family members or dealing with medical issues. In addition, ex-offenders with criminal records may run into barriers to employment while employers could miss an opportunity to locate additional talent. Learning objectives include:
- Defining unemployment discrimination and employment gaps and the reasons why employers are concerned about that issue.
- Explaining how discrimination on the basis of current employment and employment history can potentially discriminate on the basis of gender, age, or medical condition.
- Discussing the reasons to consider applicants who are unemployed or have employment gaps or criminal records.
- Reviewing an organization’s policies and procedures to ensure compliance with the U.S. Equal Employment Opportunity Commission (EEOC) guidance on criminal records as well as “Ban the Box” laws in order to avoid disparate impact in hiring.
The agenda for the webinar will include defining what is “unemployment discrimination,” legal and practical reasons for employers to consider hiring individuals who are unemployed, specific issues with discrimination and hiring ex-offenders, and dealing with questions about past unemployment history in interviews, reference checks, and job announcements.
