On February 25, 2020, the Federal Trade Commission (FTC) – the nation’s primary privacy and data security enforcer – released its annual “Privacy and Data Security Update for 2019” that highlighted a record year for enforcement actions over consumer privacy and data security, according to an FTC press release.

The FTC’s privacy and data security update for 2019 states that the FTC “has brought hundreds of privacy and data security cases to date” and “has also called on Congress to enact comprehensive privacy and data security legislation, enforceable by the FTC.” Highlights of FTC actions in 2019 include:

The FTC – along with the CFPB – enforces the federal Fair Credit Reporting Act (FCRA) that regulates background checks for employment purposes in the United States. The FCRA also regulates the companies that provide background check reports known as consumer reporting agencies (CRAs).
