Attorney Lester Rosen, founder and chief executive officer (CEO) of leading global background check firm Employment Screening Resources® (ESR), will give a presentation titled “What Every Employer Needs to Know: Background Checks & Hiring” at an event sponsored by the San Francisco Employer Advisory Council (SF EAC) from 8:30 a.m. to 10:00 a.m. on Thursday, April 2, 2020. Just one bad hire can result in a legal and financial nightmare. Without taking appropriate steps, employers may hire someone with an unsuitable criminal record or a falsified background that can result in workplace violence, lawsuits for negligent hiring, and time wasted recruiting and hiring the wrong person. On the other hand, there is a rising tide of litigation, legislation, and regulation making hiring more complex than ever. 

In the presentation by Rosen, attendees will learn legally complaint best practices to keep their businesses productive and out of court. Rosen will explore how to obtain and utilize criminal records on job applicants consistent with “Ban the Box” and Fair Chance hiring laws. He will also examine the U.S. Equal Employment Opportunity Commission (EEOC) approach to the non-discriminatory use of criminal records. 

Attendees will learn how to avoid class action lawsuits under the federal Fair Credit Reporting Act (FCRA), and how to view best practices when it comes to the application, interview, and reference checking process. They will leave the session with an understanding of immediate steps employers can take to both avoid bad hires and staying compliant by creating a screening policy that stands up to a legal review. Attendees will also:

  • Learn how the background screening landscape has changed and the due diligence needed to have in place to avoid a lawsuit. 
  • Understand the basics of a negligent hiring lawsuit and defenses that work and do not work.
  • Get acquainted with cutting edge issues and new legislation that affects employers such as “Ban the Box,” the EEOC Guidance on criminal records, and the latest on FCRA class action lawsuits. 
  • Learn how to spot fraudulent employment and education credentials.
  • Get updated on the latest best practices and new technologies.
  • Understand the legal and practical challenges in using social media and credit reports as part of a due diligence program.
  • Learn what organizations can do today to ensure a legally compliant program and hire the best employees.

The event hosted by the SF EAC will take place at Pearson Education, 50 California Street, 18th Floor, in San Francisco, California. Registration, networking.
