On September 10, 2020, the Federal Trade Commission (FTC) released the agenda for the virtual “FTC Workshop on Data Portability” that will take place on September 22, 2020, to examine the potential benefits and challenges to consumers and competition raised by data portability, according to a press release from the FTC.

“Data portability” gives consumers more control over their data, allowing them to move data – such as emails, contacts, calendars, financial information, health information, favorites, friends, or content posted on social media – from one service to another or to themselves. The workshop will feature four panel discussions about:

  • Data Portability Initiatives in the European Union, California, and India: Case Studies – This panel will discuss the European Union’s General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other data portability initiatives, including lessons learned from those efforts.
  • Financial and Health Portability Regimes: Case Studies – This panel will discuss efforts to implement data portability in the financial and health sectors, and lessons learned from those efforts.
  • Reconciling the Benefits and Risks of Data Portability – This panel will discuss the attributes, benefits, and challenges of data portability initiatives, with an eye towards the twin aims of protecting consumers and promoting competition.
  • Realizing Data Portability’s Potential: Material Challenges and Solutions – This panel will discuss several key concerns confronting data portability initiatives: security, privacy, standardization, and interoperability.

Andrew Smith, Director of the FTC’s Bureau of Consumer Protection, will give opening remarks, followed by a presentation from Peter Swire, the Elizabeth and Tommy Holder Chair of Law and Ethics at the Georgia Tech Scheller College of Business. Ian Conner, Director of the FTC’s Bureau of Competition, will deliver closing remarks.

The workshop, which starts at 8:30 a.m. Eastern Time, will be held online. Information on viewing the webcast will be released prior to the event. The FTC works to promote competition and to protect and educate consumers.
