Attorney Lester Rosen, the founder and chief executive officer (CEO) of leading global background check firm Employment Screening Resources® (ESR), will present a webinar titled “Screening Applicants Using Social Networking Sites: Legal or Liability?” hosted by Lorman to alert employers about the legal risks of social media background checks on Thursday, July 8, 2021, from 10:00 a.m. to 11:30 a.m. Pacific Time. “Utilizing social media to learn about potential employees can be an effective tool – just make sure it doesn’t become a legal risk. Employers and recruiters aren’t only using search engines to find information on applicants but are now examining social networking sites, such as Facebook®, LinkedIn®, or Twitter®, as well as blogs and other online sources,” explains Rosen, a background check expert and the author of “The Safe Hiring Manual.”

For job applicants, social networking sites are places to interact with peers in any manner they choose. Entries on these sites are typically not meant for employers to view. Conversely, some job applicants feel they have been denied opportunities unfairly by employers or recruiters that snoop on social websites and view materials out of context or web entries that are meant just in fun for friends. Attendees of the webinar will be able to:

  • Explain why recruiters and employers have an interest in incorporating social networking sites in their process to screen applicants.
  • Define potential online tools for employers – search engines, social networking sites, blogs, and chat rooms.
  • Describe the social media that can source candidates.
  • Identify how Web 2.0 has made it extremely easy for job applicants to create fake employment and education credentials.

The webinar agenda includes the sudden interest by recruiters and employers in using social networking sites, potential online tools for employers, social media to source candidates, can background screening firms perform social media searches for employers consistent with the Fair Credit Reporting Act (FCRA), the legal landscape, and passwords. To register for the webinar, which is worth credits from several organizations, click here.

Rosen was on the steering committee that founded the Professional Background Screening Association (PBSA), which was formerly known as the National Association of Professional Background Screeners (NAPBS) before rebranding to a new name in 2019. That same year, Rosen received the PBSA Lifetime Achievement Award that recognizes an individual’s contributions that have advanced excellence in the screening profession.
