Attorney Lester Rosen, founder and chief executive officer (CEO) of Employment Screening Resources® (ESR), will present two sessions for members of the Society for Human Resource Management (SHRM) at the upcoming 2021 SHRM Annual Conference & Expo that will be held in Las Vegas, Nevada, from September 9 to 12, 2021.

Rosen will present a session titled “A Strategic Approach to a Legally Compliant and Effective Background Screening Program” on Friday, September 10, 2021, from 3:45 PM to 4:45 PM Pacific Time. He will provide updates on federal and state laws, lawsuits, and regulations controlling pre-employment background checks.

Attendees will learn how the federal Fair Credit Reporting Act (FCRA) and similar state laws impact employers that perform background checks on job applicants, and understand the explosion in class action lawsuits related to background checks and learn how to audit their screening program for legal compliance and best practices.

Rosen will also present a session titled “The Use of Criminal Records in Hiring: Land Mines and Opportunities for Employers” on Saturday, September 11, 2021, from 2:30 PM to 3:30 PM Pacific Time. He will provide insights on compliance issues when using criminal records in hiring and the need to give ex-offenders a second chance.

Attendees will learn the impact that the U.S. Equal Employment Opportunity Commission (EEOC) guidance, “Ban the Box” laws, and second chance programs have on the use of criminal records by employers, and why it is more important than ever to give ex-offenders with criminal histories the opportunity to reenter the workforce.

“To avoid bad hiring decisions, employers utilize pre-employment background screening as a risk management tool,” explains Rosen, the author of “The Safe Hiring Manual” and a noted background check expert. “However, background checks are becoming increasingly subject to litigation, legislation, and regulation.”
