The U.S. Department of Transportation’s (USDOT) Federal Motor Carrier Safety Administration (FMCSA) has declared a motor carrier located in the Houston, Texas area, to be an “imminent hazard” to public safety and ordered it to cease all interstate and intrastate operations in an Imminent Hazard Order issued on May 31, 2022.
The motor carrier was declared an imminent hazard after the FMCSA determined it began operating as another motor carrier to avoid the Imminent Hazard Order issued on May 7, 2022, that specifically noted that a motor carrier “cannot avoid this ORDER by continuing operations under the name of another person or company.”
However, the motor carrier did just that by operating under another company name which used common ownership, common management, common control, and/or common familial relationship to enable the motor carrier and its principal to avoid the Imminent Hazard Order issued on May 7, 2022.
The FMCSA’s imminent hazard out-of-service order stated the motor carrier’s “…avoidance of compliance with the [federal safety regulations] and the [motor carrier] substantially increases the likelihood of serious injury or death for your drivers and the motoring public if your operations are not discontinued immediately.”
Failing to comply with the provisions of the Federal imminent hazard order may result in civil penalties of up to $29, 893 for each violation. The motor carrier may also be assessed civil penalties of not less than $11,956 for operating authority registration and up to $16,864 for operating without USDOT Number registration.
