On August 8, 2023, the Monroe County legislature in the state of New York adopted a local law entitled the “Monroe County Fair Chance Employment Act” (No. 23-0181) that will allow the County to “Ban the Box” and prohibit applications for County employment from inquiring about the criminal history of job applicants.

The Monroe County “Ban the Box” Act will also prohibit the County from completing a criminal background check on a job applicant until after a conditional offer of employment has been made. However, the Act will make exceptions for law enforcement positions requiring a background check before a job offer is extended.

Monroe County joins other localities in New York State that have adopted “Ban the Box” policies including Albany County, Buffalo, Dutchess County, Ithaca, New York City, Rochester, Suffolk County, Syracuse, and Westchester County. New York State also has a “Ban the Box” law regarding government employment.

“Ban the Box” – which refers to the box on job applications that applicants are asked to check if they have a criminal record – is a nationwide movement. As of 2023, 37 states and more than 150 cities and counties have adopted “Ban the Box” legislation, according to a guide from the National Employment Law Project (NELP).
