On November 3, 2020, the U.S. Equal Employment Opportunity Commission (EEOC) entered into a revised Memorandum of Understanding (MOU) with the U.S. Department of Justice (DOJ) and the U.S. Department of Labor’s (DOL) Office of Federal Contract Compliance Programs (OFCCP) that will amend procedural rules to enhance the effectiveness and accountability of the conciliation process, according to an EEOC press release.
The revised MOU – approved by the EEOC on November 2, 2020 – promotes interagency coordination in the enforcement of equal employment opportunity (EEO) laws, maximizing efficiency, and eliminating duplication and inconsistency among the three agencies. While not previously a signatory to the MOU, the inclusion of the DOJ epitomizes a renewed commitment by three of the country’s premier civil rights agencies to work together.
First entered into in 1970, the MOU reinforces coordination and cooperation between OFCCP and the EEOC in processing complaints of employment discrimination and ensures a consistent approach to the agencies’ enforcement and remedial efforts.
